OpsEngine – Terms of Service

These Terms of Service(“Terms”) govern your access to and use of services provided by OpsEngine by American Man LLC (“OpsEngine,” “we,” “our,” or “us”).

By accessing our website, subscribing to our services, or using OpsEngine systems, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services.

1. Acceptance of Terms

By using our website or services, you represent that:

• You are at least 18 years old

• You have the authority to enter into a binding agreement

• You have read, understood, and agree to these Terms

2. Services Provided

OpsEngine provides marketing, automation, and SaaS-based systems for service providers and small businesses.

Services may include, but are not limited to:

• CRM and automation tools

• SMS and email communication systems

• Call tracking and missed-call workflows

• Website and funnel hosting

• Appointment scheduling

• Reporting dashboards

• Training, support, and consulting

We reserve the right to modify, suspend, or discontinue any service or feature at any time, with or without notice.

3. User Responsibilities

3.1 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials

• Ensuring secure password practices for all users on your account

• All activity that occurs within your account

Any unauthorized access must be reported to OpsEngine immediately.

3.2 Lawful Use

You agree not to:

• Violate any applicable laws or regulations

• Abuse, misuse, or exploit our systems

• Engage in spam, fraudulent, deceptive, or harmful communications

• Attempt to reverse engineer, disrupt, or compromise platform functionality

Violation of this section may result in immediate termination without refund.

4. Billing & Subscription Terms

4.1 Recurring Payments

OpsEngine services operate on a recurring subscription basis.
By subscribing, you authorize recurring charges to your selected payment method until canceled.

4.2 Pricing Changes

We may update pricing at any time. Existing subscribers will be notified before any changes take effect.

4.3 Taxes

You are responsible for all applicable taxes, duties, or fees based on your location and usage.

5. Refund Policy (Strict / No Refunds)

OpsEngine provides digital services, SaaS access, automations, system provisioning, and account setup that are delivered immediately and cannot be returned.

All payments are final and non-refundable.

This includes, but is not limited to:

• Monthly or annual subscriptions

• Setup or onboarding fees

• Training or consulting services

• System provisioning or snapshot installations

• Any time-based or usage-based services

No refunds will be issued for:

• Early cancellation

• Failure to use the services

• Perceived lack of results

• User error or misconfiguration

• Inability or unwillingness to implement recommended processes

To avoid additional charges, cancellations must be completed prior to the next billing cycle.

6. Cancellations

You may cancel your subscription at any time by:

• Submitting a written request to [email protected], or

• Using the billing portal link included in your subscription emails

Cancellations take effect at the end of the current billing cycle.
Canceling does not entitle you to a refund.

7. Third-Party Services & Links

OpsEngine integrates with and may contain links to third-party services and websites, including but not limited to:

• HighLevel (LeadConnector)

• Stripe

• Google Workspace

• SMS and email carriers

• Advertising and analytics platforms

We do not control, endorse, or assume responsibility for third-party platforms, outages, policy changes, content, or practices.
Use of third-party services is at your own risk.

8. SMS, Email, and Call Compliance

SMS Use Cases

By opting in, you agree to receive SMS messages from American Man LLC, operating as OpsEngine, related to appointment confirmations, scheduling updates, onboarding information, service notifications, and other account-related communications. SMS messages are only sent to users who have explicitly opted in through our website forms or booking calendar.

Opt-Out Instructions

You may opt out of receiving SMS messages at any time by replying STOP to any message. After opting out, you will no longer receive SMS messages from us unless you re-enroll. For assistance, reply HELP or contact us using the information provided on our website.

Message & Data Rates Disclosure

Message and data rates may apply depending on your mobile carrier and plan. Message frequency may vary based on your interactions with our services.

Carrier Liability Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to effective transmission from your mobile service provider and is not guaranteed by American Man LLC, operating as OpsEngine.

9. Limitation of Liability

To the maximum extent permitted by law, OpsEngine is not liable for:

• Loss of revenue or profits

• Business interruption

• Lost leads, missed messages, or delivery failures

• System downtime or outages

• Errors in user configuration or implementation

• Third-party service failures

Our total liability shall not exceed the amount paid by you to OpsEngine in the 30 days preceding the claim.

10. No Warranty / Results Not Guaranteed

OpsEngine provides systems, tools, and automation but does not guarantee results, including:

• Lead volume

• Revenue increases

• Response or conversion rates

• Appointment show rates

Results depend on your business model, industry, offer, and execution.

11. Intellectual Property

All OpsEngine intellectual property, including but not limited to:

• Systems

• Workflows

• Automations

• Snapshots

• Branding

• Training materials

is protected by copyright and intellectual property laws and may not be copied, resold, shared, or redistributed without written permission.

12. Termination

We may suspend or terminate your account immediately if:

• You violate these Terms

• You engage in unlawful, abusive, or harmful behavior

• Your billing fails repeatedly

• Your actions compromise system integrity

No refunds will be issued upon termination.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms at any time.
Updates will be reflected by a revised “Last Updated” date.
Continued use of OpsEngine services constitutes acceptance of the updated Terms.
